ABOUT THE DEVELOPER

Dakota Dunes is owned and developed by Dakota Dunes Development Company, a subsidiary of MidAmerican Energy Holdings Company (MEC).

MidAmerican is one of the largest utility holding companies in the U.S., headquartered in Des Moines, Iowa.


EXPERTLY PLANNED

The Dakota Dunes community was planned by Edward D. Stone and Associates, an internationally recognized architectural and planning firm.

Of the 2,000 acres included in the development, approximately 434 acres have been reserved for office, light industrial and retail facilities; 543 acres for residential single family houses, townhomes and apartments; 343 acres for two golf courses and 627 acres for open space and right of way.

ORGANIZATIONS OF DAKOTA DUNES


DAKOTA DUNES COMMUNITY IMPROVEMENT DISTRICT (CID)

The Dakota Dunes Community Improvement District (CID) is organized as a local unit of special purpose government and is essentially the "city" of Dakota Dunes. The CID is technically a sub-division of Union County. It was formed under the County portion of State law and functions similarly to a city government. The CID differs from a city government in two major ways. One, the CID cannot, by law, levy a local sales tax. Goods and services purchased in Dakota Dunes are only subject to a state sales tax, currently four percent, which State Government uses to fund its operations. Since the CID does not have the sales tax revenue stream of a city, the general fund operations (streets, storm sewers and general maintenance) are funded only with property tax dollars. The second difference between a CID and a city is that the CID is not allowed police powers and therefore does not fund or operate a police department. Police protection is provided by the Union County Sheriff's Office and is paid for with property taxes paid to the County. Dakota Dunes CID does provide a security service which is meant to monitor and patrol Dakota Dunes and work with the Sheriff's Office.

The CID is also responsible for potable water and sanitary sewer services within the geographic boundaries of Dakota Dunes. The CID has a water plant with the ability to treat approximately 2.3 million gallons per day and also has a connection to Sioux City's water system that allows the CID to purchase up to an additional 2.7 million gallons per day. The community's wastewater is collected and pumped to Sioux City for treatment under a long-term contract. These services are paid for by residential and commercial water and sewer fees.

The CID is governed by a five-member elected Board of Supervisors. Each member is elected to a six-year term which is staggered at two-year intervals. The day-to-day management is handled by the District Manager who reports to the Board of Supervisors. The CID's main objective is to operate and maintain the Dunes' basic infrastructure.

DAKOTA DUNES COMMUNITY ASSOCIATION, INC.

Dakota Dunes Community Association, Inc. was organized by Dakota Dunes Development Company with a general plan of standards for the benefit of all residential owners within Dakota Dunes. The Community Association is responsible for the enforcement of the covenants. It also handles the administration of the design review process and the maintenance, repair and improvement of entry features within the Dakota Dunes residential development. All residential property owners pay assessments which fund operating expenses of the Community Association. Currently the residential assessments are $15/month billed quarterly with a $30 initiation fee.

In 1993, the Board of Directors established neighborhood groups that determine the Voting Members for the Association. There are currently 21 neighborhoods in Dakota Dunes with elected chairpersons who serve as the Voting Member for their respective neighborhoods. The neighborhood representatives serve as liasions between residents and the Board of Directors. Their meetings serve as a forum to exchange project information and concerns. According to the By-laws of the Association, each Neighborhood bi-annually elects a three-person committee.

The Association is governed by a Board of Directors consisting of five members elected by the Voting Members. One represents The Meadows, one The Prairie, one the west side of The Country Club, one the east side of The Country Club and one At-Large.

DAKOTA DUNES COMMERCIAL ASSOCIATION, INC.

The Dakota Dunes Commercial Association, Inc. was established in August 1990. The purpose of the Commercial Association is to establish covenants, conditions and restrictions upon the commercial property at Dakota Dunes. This is done for the benefit of all owners of commercial property to provide a methodology for the administration, maintenance, preservation, use and enjoyment of the commercial property. All owners of commercial property pay assessments which fund operating expenses of the Commercial Association.

The Commercial Association is governed by a five-person Board of Directors elected by the commercial members of the Commercial Association.

All construction activity for commercial buildings must be submitted and reviewed by the Design Review Committee to insure compliance with the covenants, conditions and restrictions of the Commercial Association.

DESIGN REVIEW COMMITTEE (DRC)

The Design Guidelines for Dakota Dunes have been established to implement the highest quality of design standards for the Dakota Dunes community. They serve as the framework of design concepts and standards for the construction of a variety of housing types and commercial buildings. They have been established to compliment the Declaration of Covenants, Conditions and Restrictions (CC&A's) for the Dakota Dunes Community Association and the Dakota Dunes Commercial Association.

The DRC consists of appointees by Dakota Dunes Development Company who review and approve the design and initial construction of homes. The DRC requires that submittals for site, architectural plans, exterior materials and landscaping plans are received and approved prior to their construction and/or installation. The DRC requires a $500 deposit at the time of a lot sale in The Prairie and a $1,000 deposit at the time of a lot sale in The Country Club, The Meadows and commercial property which is refunded after construction upon meeting the design guidelines. In addition, the DRC facilitates the requests for any modifications to residences after the initial construction. The following is a key list of items which require DRC review and approval:

- Additions or alterations affecting the home exterior
- Antennas
- Basketball hoops
- Clothelines
- Decks
- Dog kennels
- Exterior lighting or decorative items
- Fencing or walls
- Flagpoles
- Landscaping changes or enhancements
- Painting or roof replacement
- Play equipment, i.e. swing sets, trampolines, etc.
- Swimming pools, hot tubs, etc.
- Tree installation or removal

Each of the above items is referred to in detail in the CC&R's and the Design Guidelines. They are listed here as a quick checklist to remind of actions that require submittal to the DRC. Modification request forms are available at the Dakota Dunes Welcome Center and Dakotadunes.com.

DAKOTA DUNES COUNTRY CLUB

Dakota Dunes Country Club is a private club featuring an Arnold Palmer designed golf course. The Club is responsible for managing and maintaining the golf course and other Club facilities. The 20,000 sq. ft. clubhouse includes dining facilities, the Palmer Lounge, locker rooms, fitness center, banquet facilities and pro shop. The Club complex includes an outdoor swimming pool and four outdoor tennis courts. The Club is governed by a seven-person Board of Managers.

DAKOTA DUNES DEVELOPMENT COMPANY (DDD)

Dakota Dunes Development Company is the master developer of the 2,000 acre master planned community. DDD owns the undeveloped land, Two Rivers Golf Course, and the unsold but improved lots. DDD is responsible for constructing the infrastructure at Dakota Dunes which includes water, sewer, roads, parks, etc. DDD then sells residential lots and commercial land. DDD is also manager of the Dakota Dunes Community Association and the Dakota Dunes Commercial Association. Two Rivers is a public 18-hole golf course adjacent to the Big Sioux River located within the Two Rivers Business Park. The course was established over 100 years ago.
